i was the one who posted and asked all y'all about information concerning current/recent legal issues in the NHL. for a refresher, i'm a law student taking a sports law class down here in san diego. for the class, i'm supposed to write a paper about a current sports legal issue. i'm supposed to discuss who the parties are, what are their issues and arguments, the outcome (if there has been an outcome), and its future effects. initially, i thought about the new CBA from a few years back and its effects on future contracts. i got a couple awesome replies with very helpful links.
however, i thought i'd change gears and discuss another current NHL litigation matter...the todd bertuzzi/steve moore incident. basically my question is what is the status of that case? i'm researching online and the most recent thing i found was the bertizzui offered a $350K settlement to moore, who has refused. is this case still in the works or has it been settled and done with?
plus, does anyone know any links that can point me to the right direction that describes the legal aspects behind the incident?
i'm still debating on whether to write about the CBA topic or the bertuzzi/moore incident...anyone information on either would be awesome!
Write about how the Bruce McNall with the help of Al Davis, the Coliseum Commission and a couple of Hollywood types baited Jerry Buss into selling the Kings to him.
All with the hopes that he, Buss, would be able to buy then transfer an NFL franchise to LA and build a stadium on Hollywood Park Parking lot.
And all the legal fallout that happened with McNall and the Kings
the sports law class is a "practicum" class that requires you to research and write about a current sports litigation case. research and write...thats pretty much what law school is...don't really see anything wrong with that.

There's a Hastings Journal comment/note/article on the Bertuzzi/Moore case (though, I'm not sure it's the Law Review, I think it's one of their topical journals).

in my sports law class, i wrote about the prosecution of marty mcsorley for the brashear incident. came up with a defense strategy under canadian law and advocated against criminal prosecution for on-ice incidents where there is no clear criminal act.
interesting note: to the point of the mcsorley incident, there had only been nine or so prosecutions for on-ice incidents among professional hockey players. in all but one case, only visiting players were prosecuted. that's home cookin'.
anyway, i'd definitely go with the bertuzzi case. far more interesting. what are the damages in an intentional tort case like that? what future earnings could moore seek, and how would they be determined? what's the metric for determining what he could earn over a professional lifetime? are punitive damages likely to occur, and who is liable for them? does respondeat superior apply where the injurious act is criminal, and therefore presumably outside the course and scope of employment? and what of the assertion that crawford ordered the hit? if that's true, what result?
there are a ton of interesting questions. any one of them is a paper unto itself.

damn thats a pretty interesting project that you did with the mcsorley case. for our class, the professor wants us to contact the parties if possible to get inside information about the topic. not as interesting as your class i'm sure...lol...
an adjunct professor is teaching this course at my law school....professor teaff is his name...
