That was neither a liberal or moderate vote...it was a STUPID vote.

All kinds of positions across the political spectrum can be held in a stupid fashion. What's your actual point?
This was a "moderate" vote in that it was temporizing and "pragmatic."
It was taken to please Blue Dog Democrats in the Congress who face close elections against Republicans who would bash them for being "soft" on terrorism if a better law had been passed by Congress and then vetoed by Bush anyway. Obama also innoculated himself against McCain making the same charge against him since McCain has one campaign "issue"...fear.
Is it what should have been done in the best of all possible worlds? No. Is it a reasonable but unsatisfying vote to make if one wants to win an election and gain control of the Congress and the executive branch? Obviously.

It was a stupid vote in the respect that it retroactively protects law breakers from punishment, threatens civil liberties, and encourages his political opponents to take more risks knowing that he won't stand up and be strong. You would think a constitutional law professor would have at least some respect for the Constitution...
And if you say it was pragmatic I will grant you that it was an EXPEDIENT vote.

Agree with everything except that it encourages his opponents. They right wing already knows what they think and what they'll do on civil liberties issues and Obama won't discourage them. I think it may be more discouraging to see that Obama isn't going to commit political suicide.
I think it's pretty clear Obama knows what the Constitutional issues are and is on the right side of those issues. The question here is, does he help his opponents attack him so they can win more easily and pack the Supreme Court with three more insane justices, or does he temporize and do the expedient, pragmatic thing?
